WILL OF

JOHN HARKNESS

The State of South Carolina 

In the name of God Amen. I John Harkness of Anderson District in the State of South Carolina becoming infirm of body – but by the blessing of God of sound and disposing mind and Memory and understanding – do make this my last will and testament hereby revoking and making void, all former and other Wills at any time made by me. In primis, I order and direct all my Just debts and funeral expenses to be paid by my Executors as soon after my decease as possible. 

    Item. It is my will and I hereby enjoin it upon my Executors that there shall be no unnecessary costs nor charges in the final arrangements and settlement of my Estate and for that purpose and to that end. I hereby devise and bequeath unto my three sons Robert C Harkness John N Harkness and James I Harkness all the lands & Real Estate of which I may die seized and possessed, share and share alike and to carry out my wishes in relation thereto, I direct that my Executors shall lay out or cause to be laid out into three divisions or parts as nearly equal as possible in quantity and quality all the lands aforesaid and for each of my Sons aforesaid to take one part and in case there should be a difference of opinion as to the value of each part then, they shall draw for the same by lot, or he who should have the most valuable part shall pay to the other having a part of less value such a sum of money as shall make the three shares of the same value.

I give and bequeath to the children of my Daughter Polly H Pettigrew One Thousand Dollars.

    Item. I give and bequeath to the children of my Daughter Rosa Ann Clinkscales One Thousand Dollars. 

    Item. I give and bequeath to the children of my Daughter Eliza Jane Gaillard One thousand Dollars. 

    Item. All my personal Estate of what nature or kind soever whether of Negroes Goods and chattels, household and kitchen furniture, farming utencils, stock Books, Bonds, Notes, and Money, or of anything else of which I may die siezed and possessed I hereby Give devise and bequeath unto my sons Robert C Harkness, John N Harkness and James I Harkness and. My Daughter Nancy N Pratt to be equally divided between them share and share alike.

    Item. and lastly I hereby nominate, constitute and appoint my Sons, Robert C Harkness, John N Harkness and James I Harkness Executors of this my last will and Testament. 

    In witness whereof I have hereunto set my hand and affixed my seal this Twenty Sixth 26th day of December in the year of our Lord One thousand, Eight hundred and fifty three and in the Seventy-Seventh year of the Sovereignty and Independence of the United States of America.
